Privacy Policy

1. Introduction

Clouted, Inc. ("the Company," "we," "us," or "our") operates the website cloutktichen.com and the Clouted platform (the "Service"). Clouted is an AI-powered content distribution tool: you upload a video clip once, and the Company's platform automatically reformats it, generates platform-appropriate captions, and schedules posts across TikTok, Instagram, YouTube, LinkedIn, X, and Pinterest. This Privacy Policy explains what information we collect when you use the Service, how we use it, who we share it with, and the rights you have over your information.

2. Information We Collect

2.1 Information You Provide

We collect information you submit directly to the Service, including:

  • Account registration data (name, email address, password);
  • Billing information processed through our payment provider when you subscribe to a paid plan;
  • Video clips and associated metadata (titles, descriptions, platform-targeting choices) that you upload for the Company to reformat and distribute;
  • Caption preferences, brand voice settings, and scheduling configurations you set within the platform;
  • Team member names and email addresses when you invite collaborators under a Team plan;
  • Messages you send us via contact forms or email.

2.2 Content You Upload

The core function of the Service requires us to process video files you submit. We store uploaded clips long enough to complete reformatting and scheduling tasks. We do not use the video content you submit to train machine learning models without your explicit written consent. Processed formats and scheduled content are retained according to the data-retention schedule in Section 6.

2.3 Information Collected Automatically

When you visit cloutktichen.com or use the Service, we automatically collect limited technical information:

  • IP address and approximate location (city/region level);
  • Browser type, operating system, device class;
  • Pages visited, referring URLs, time on page, feature interactions;
  • Cookie and similar identifiers (see Section 5 and our Cookie Policy).

2.4 Platform Connection Data

If you connect a social media platform account (TikTok, Instagram, YouTube, LinkedIn, X, or Pinterest) to authorize the Company to post on your behalf, we receive the OAuth tokens and profile identifiers necessary to complete that authorization. We use these tokens only to perform the scheduling and posting actions you direct. We do not read, store, or analyze your followers, messages, or other platform-side content beyond what is required to fulfill the posting action.

2.5 We Do Not Knowingly Collect Children's Data

The Service is intended for adults 18 and older and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact [email protected] and we will delete it promptly.

3. How We Use Information

We use the information we collect to:

  • Provide the core Service -- receive your clips, reformat them for each platform's requirements, generate AI-drafted captions, and execute the posting schedule you approve;
  • Manage your account, process billing, and send receipts and plan-related notifications;
  • Respond to support requests and improve our understanding of how creators and brand teams use the platform;
  • Operate, maintain, and improve the Service -- including training internal quality-assessment models on aggregated, de-identified usage signals (not on your video content);
  • Send product updates and, where you have opted in, marketing communications about new features or plans;
  • Detect, investigate, and prevent abuse, fraud, or violations of our Terms of Service;
  • Comply with applicable legal obligations.

We do not sell personal information for monetary value. Where applicable state law treats certain advertising arrangements as a "sale" or "share," see the Texas and California sections below.

4. Sharing of Information

We share personal information only with:

  • Service providers acting on our behalf (hosting infrastructure, transactional email delivery, payment processing, analytics) under contractual confidentiality terms that restrict their use of your data to providing the service we engaged them for;
  • The social media platforms you connect -- we transmit your uploaded content and scheduling instructions to TikTok, Instagram, YouTube, LinkedIn, X, and Pinterest APIs on your behalf, subject to those platforms' own terms and privacy policies;
  • Authorities, when required by law, court order, or to protect rights, safety, or property;
  • A successor entity in the event of a merger, acquisition, or asset sale, subject to this Policy and prior notice to you where feasible.

We do not sell personal information to third parties.

5. Cookies and Tracking

We use cookies and similar technologies to operate the site, remember your session and preferences, and measure usage patterns. For details and choices, see our Cookie Policy.

6. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy, to comply with legal or accounting obligations, and to resolve disputes:

  • Account data is retained while your account is active. After account deletion we purge personal identifiers within 30 days, retaining only aggregate analytics.
  • Uploaded video clips are deleted from our processing pipeline within 7 days of the final scheduled post completing, unless you store them under an active plan's asset library.
  • Platform OAuth tokens are deleted immediately if you disconnect a platform or delete your account.
  • Inactive marketing-list contacts are purged after 24 months.
  • Server access logs are retained 90 days, then aggregated.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, restricted-access databases, and least-privilege access controls. OAuth tokens for connected platform accounts are stored encrypted at rest. No system is perfectly secure; we cannot guarantee absolute security.

8. Your General Rights

Depending on your jurisdiction, you may have rights including access, correction, deletion, and the ability to limit certain processing. To make a request, email [email protected]. We will respond within the timeframe required by applicable law.

9. Texas Residents (TDPSA)

Under the Texas Data Privacy and Security Act ("TDPSA"), Texas residents have the rights described below regarding personal data we control or process.

9.1 Your TDPSA Rights

  • Right to Confirm and Access: confirm whether we are processing your personal data and obtain access to it.
  • Right to Correct: correct inaccuracies in your personal data.
  • Right to Delete: request deletion of personal data we have collected from or about you.
  • Right to Data Portability: obtain a portable copy where we maintain it electronically and where technically feasible.
  • Right to Opt Out: opt out of targeted advertising, sale of personal data, and profiling for decisions producing legal or similarly significant effects. We do not engage in any of these activities.

9.2 Sensitive Data Consent

If we ever process sensitive data as defined under TDPSA (e.g., precise geolocation, biometric, health data), we will obtain your prior consent. The Service does not currently process such data.

9.3 How to Exercise

Email [email protected]. We respond within 45 days; one 45-day extension is available with notice to you.

9.4 Appeal

If we deny your request you may appeal by replying to our response. If denied on appeal, contact the Office of the Texas Attorney General Consumer Protection Division.

9.5 California Visitors

If you are a California resident visiting from another state, you may also exercise the rights granted under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. We do not sell personal information and do not "share" personal information for cross-context behavioral advertising.

10. Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected by a new "Last updated" date and, where appropriate, a notice on the Service.
